(hereinafter “we”) and you as the customer. Deviating terms of the customer apply only if we have acknowledged them in writing. The version of these Terms valid at the time of the order applies.
2. Conclusion of contract
The presentation of products in the online shop is not a binding offer but an invitation to order. By submitting your order you make a binding offer. The contract is concluded as soon as we confirm the order by email or dispatch the goods.
Orders require that you are at least 18 years old and have legal capacity.
We reserve the right to decline orders without giving reasons, in particular in the event of obvious pricing or display errors, unavailability, or reasonable suspicion of misuse. In such cases we refund any payments already made in full and without delay.
3. Prices
All prices are in Swiss francs (CHF). We are not subject to VAT; no VAT is shown.
Shipping costs are not included in the product price. They depend on the destination country and weight and are shown in the cart and at checkout before you complete your order.
For deliveries outside Switzerland, customs duties, import charges and VAT of the destination country may apply. These are borne by the recipient and paid on delivery, unless they are shown as a separate line during the order process and covered by us. Details can be found under Shipping and payment methods.
4. Payment
We offer credit card, TWINT, PayPal and prepayment (bank transfer). Card payments, TWINT and PayPal are processed by our payment service provider Stripe.
Goods are dispatched only after payment has been received in full. Payment by invoice is not available.
If you choose prepayment, you will receive our bank details with the order confirmation. If payment does not reach us within the period stated in the order confirmation, we may withdraw from the contract and cancel the order.
5. Delivery
We deliver to Switzerland, Liechtenstein, the European countries listed during the order process, and the USA. Shipping is handled by Swiss Post.
Delivery times are guide values and not warranted characteristics. Delays caused by postal services, customs or carriers are beyond our control.
If you are a business customer, risk passes to you when the goods are handed over to Swiss Post. For deliveries to private individuals, risk passes when the goods are handed over to you.
If a product is unavailable, we will inform you promptly and refund any payments already made in full.
6. Retention of title
The goods delivered remain our property until payment has been made in full.
7. Right of return
We voluntarily grant a right of return of 14 days. The details are set out under Right of withdrawal and Returns and form part of these Terms.
8. Warranty
The statutory provisions on warranty for defects apply. The warranty period is two years from receipt of the goods.
Obvious defects and transport damage must be reported to us within seven days of receiving the goods. In the case of a justified notice of defects, we will, at our discretion, provide a replacement or refund the purchase price.
Normal wear and tear, damage caused by improper handling, excessive strain or unauthorised modifications are excluded from the warranty.
9. Business customers
If you order in the course of a professional or commercial activity, the following applies in addition: the goods must be examined immediately upon receipt; defects must be reported to us in writing within seven days, hidden defects immediately upon discovery. The voluntary right of return under clause 7 does not apply to business customers.
10. Liability
We are liable without limitation for damage caused intentionally or through gross negligence. Liability for slight negligence is excluded to the extent permitted by law. In particular, liability for indirect damage, consequential damage and loss of profit is excluded.
Liability under the Swiss Product Liability Act and for injury to life, body or health remains reserved.
Our products are intended for use in yoga. We accept no liability for injuries resulting from improper use or excessive strain.
11. Data protection
We process your personal data in accordance with our Privacy Policy.
12. Amendments
We reserve the right to amend these Terms at any time. The version published on our website at the time of your order applies to that order.
13. Applicable law and place of jurisdiction
The contractual relationship is governed exclusively by Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The exclusive place of jurisdiction is Einsiedeln, Switzerland. Mandatory places of jurisdiction for the protection of consumers remain reserved.
14. Severability
Should any provision of these Terms be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to its economic purpose.
